(A) The Town Council shall assume the authority for the collection of residential trash and recyclables, as defined above, and provide a trash and recyclables collection service solely for the benefit of, and shall be used solely by, the residents of the town. The Council shall provide the service through the use of inter-local agreements, contracts, licensing, franchise arrangements, or any method it may deem necessary to ensure that a quality service is provided to the town’s residents.
(B) Prior to awarding any contracts for trash collection under this section, the town shall assure that competitive bids are obtained. Contracts shall be re-bid periodically to assure competition for providing trash collection services hereunder. The town reserves the right to award exclusive franchises for trash collection services. No entity shall contract for, or perform residential trash collection services for, town residents without prior approval of the Town Council.
