§ 151.01 PURPOSE.
   (A)   It is the purpose of this chapter to promote and protect the public health, safety, and general welfare by providing for the regulation of the planting, maintenance, and removal of trees, shrubs, and other plants within the land publicly owned by the town.
   (B)   In addition, it is the intent of this chapter to positively affect the general appearance of the townscape and the quality of life in the town.

§ 151.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates, or requires, a different meaning.
   PARK TREE. Trees, shrubs, bushes, and all other woody vegetation in public parks and all other areas owned by the town, or to which the public has free access as a park.
   STREET TREE. Trees, shrubs, bushes, and all other woody vegetation located on rights-of-way of streets or alleys, or on real estate owned or controlled by the town.

§ 151.03 PUBLIC TREE, SHRUB, AND HEDGE CARE.
   (A)   The town shall have the right to plant, prune, maintain, and remove trees, plants, and shrubs within the easement of all streets, alleys, avenues, lanes, squares, and public grounds, as may be necessary.
   (B)   The Tree Board, or those under its direction, may act on behalf of the Town Council to fulfill this responsibility. In all instances, property owners who may be effected by this work shall be notified in writing and consulted prior to the start of the work.

§ 151.04 SUBDIVISIONS; DEVELOPMENT OF COMMERCIAL PROPERTY.
   In subdivisions or when the development of commercial property occurs, the Tree Board will review landscaping plans and may require street trees to be planted in or along the rights-of-way, parking lots, parks, or other public places.
