§ 95.10 REPAIR AND MAINTENANCE OF DRAINAGE FEATURES REQUIRED.
   (A)   The owner of real property located in the city has the duty to repair and maintain all drainage ditches, swales or other stormwater structures presently located upon his or her property, or shown upon any plat of his or her property that appears on record in the County Court Clerk's Office. This duty to repair and maintain drainage facilities shall extend to such actions as may be necessary to ensure proper function of the drainage facilities. The property owner shall promptly remove all foreign objects, silt and debris from such drainage facilities and shall not permit vegetative growth in any drainage facility to exceed five (5) inches in height.
   (B)   A property owner's failure to comply with this duty shall be deemed a nuisance under this chapter and addressed as such.
   (C)   A property owner's failure to comply with the duty described above shall allow the city to take all necessary action to correct the noncompliance and the cost thereof shall be borne by the property owner. The city shall have the right to place a lien upon the property to assure payment of all costs incurred by the city for the repair and maintenance of all drainage facilities.
