§ 97.01 EASEMENT GRANTED.
   The Chicago, Milwaukee, St. Paul, and Pacific Railroad Company be and it is hereby granted a right-of-way across West Street between Blocks 32 and 19 in Van Meter’s Addition to the city in accordance with a plat and plan now on file herein in the office of the City Finance Officer, reference to which is hereby made for further particulars, for the purpose of constructing a railroad track across West Street, between the blocks, provided, however, that the construction of the railroad track across West Street shall conform to the present grade of the street or that the railroad company shall at its own expense construct and maintain proper and adequate approaches to the track in the street for use of public travel therein, and, provided further, that the railroad company shall keep the railroad track at the point of its crossing the street so planked in the center and upon the approaches to the track from both the north and the south that the presence of the railroad track will in no manner impede or prevent the use of West Street across the track for any and all ordinary purposes of vehicular travel.
