No person operating a motor vehicle upon the public streets which has been stalled and/or improperly parked within the roadway because of the condition of the streets shall abandon the vehicle within the roadway. The vehicle shall be considered abandoned if the owner or operator is not with the vehicle. A person in violation of this section shall be punished by a fine set by resolution.
