For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALLEYWAYS. Every way or place of whatever nature and of 20 feet or less in width which is open to the use of the public, as a matter of right for the purposes of vehicular traffic.
AUTHORIZED PARKING ZONE. A geo-fenced area, designated by a license-holding operating authority and authorized by the City Manager or designee, that limits where dockless vehicles can be parked or stored on public property.
BICYCLE ROUTE. A system of bikeways designated by appropriate route markers, and by the jurisdiction having authority.
BICYCLE TRAIL. A separate trail or path from which motor vehicles, mopeds, and snowmobiles are prohibited and which is for the exclusive use of bicycles or the shared use of bicycles and pedestrians. Where the trail or path forms a part of a highway, it is separated from the roadways for motor vehicle traffic by an open space or barrier.
BIKEWAY. Any road, street, path, or way which in some manner is specifically designated as being open to bicycle travel, regardless of whether the facilities are designated for the exclusive use of bicycles or are to be shared with other transportation modes.
BUSINESS DISTRICT. The territory contiguous to a street when 50% or more of the frontage thereon for a distance of 300 feet or more is occupied by buildings in use for business.
DESIGNATED BICYCLE LANE. A portion of a roadway or shoulder which has been designated for use by bicyclists. It is distinguished from the portion of the roadway for motor vehicle traffic by a paint stripe, curb, or other similar device.
DOCKLESS VEHICLE. An electric motorized vehicle for commercial use, e.g., electric bicycle, motorized foot scooter.
DOUBLE PARKING. The standing of a vehicle upon a street at the rear of another vehicle which is parked diagonally at the curb, or the standing of a vehicle upon the street alongside and parallel to another vehicle which is parked parallel to the curb.
ELECTRIC BICYCLE. A bicycle or tricycle that is equipped with a seat or saddle, with operable pedals for propulsion, and with an electric motor of 750 watts or less. This includes electrically assisted bicycles (see SDCL § 32-20B-9).
ELECTRIC PERSONAL ASSISTIVE DEVICE. A self-balancing 2 non-tandem wheeled device, designed to transport only 1 person, with an electric propulsion system that limits the maximum speed of the device to 15 miles per hour or less, e.g., hoverboard, one-wheel.
INTERSECTION. The area embraced within the prolongation of the lateral curblines, or, if none, then the lateral boundary lines of 2 or more streets which join one another at an angle, whether or not 1 such street crosses the other; but the area, in the case of the point where an alley and a street meet shall not be deemed an intersection.
MOTOR VEHICLE. Every vehicle as herein defined which is self-propelled.
MOTORIZED FOOT SCOOTER. A wheeled conveyance, with handlebars, designed to be stood or sat upon by the operator; powered by an electric motor that is capable of propelling the device with or without human propulsion; that has more than 2 12-inch or smaller diameter wheels; and that has a motor that is capable of a maximum speed of 15 miles per hour on a flat surface with not more than 1% grade in any direction when the motor is engaged.
OPERATING AUTHORITY. An entity licensed by the city to own, operate, and offer dockless vehicles for use.
PARKWAY. The paved or unpaved strip of land paralleling the public roadway or located between the curbline and the property line or platted street boundary.
PUBLIC ROADWAY. The portion of a street designated or commonly used for vehicular traffic, and where curbs are laid, that portion from back-to-back of the curbs.
REBALANCE. The collection of dockless vehicles on public property, by the operating authority, back to the operating authority's business address.
RESIDENCE DISTRICT. The territory contiguous to a highway not comprising a business district when the frontage on the street for a distance of 300 feet or more is mainly occupied by dwellings or by dwellings and buildings in use for private residence.
RIGHT-OF-WAY. The privilege of the immediate use of the street.
SAFETY ZONE. The area or space officially set aside within a highway for the exclusive use of pedestrians and which is so plainly marked or indicated by proper signs while set apart as a safety zone.
SHARED ROADWAY. A roadway which is officially designated and marked as a bicycle route, but which is open to motor vehicle travel and upon which no bicycle lane is designated.
SIDEWALK. The walk provided for and used by foot passengers at the side of a street.
STREET. Every way or place of whatever nature open to the use of the public, as a matter of right, for the purposes of vehicular travel. The term STREET shall not be deemed to include a roadway or driveway upon grounds owned by private persons, colleges, universities, or other institutions.
VEHICLE. Every device in, upon, or by which any person or property is or may be transported or drawn upon a public highway, excepting devices moved by human power or used exclusively upon stationary rails or tracks, provided that, for the purpose of this chapter, a bicycle or a ridden animal shall be deemed a VEHICLE.
WHEELCHAIR. A manually operated, or power driven, device designed primarily for use by an individual with a mobility disability for the main purposes of indoor or of both indoor and outdoor locomotion.
