There is hereby established for Council and all boards, commissions, committees, agencies, authorities or similar decision-making bodies of the City the following method whereby any person may determine the time, place and purpose of all regularly scheduled, special and emergency meetings:
(a) A regular meeting schedule for the succeeding month shall be available no later than the twenty-fourth day of each month. Should the twenty-fourth day fall upon a Saturday or Sunday, the schedule shall be available on the preceding Friday. This schedule shall include all public bodies of the City. "Public body" means any board, commission, committee or similar decision-making body of the City.
(b) A public body shall not hold a special meeting unless it gives at least twenty-four hours advance notice to the news media and others that have requested notification, except in the event of an emergency requiring immediate official action. In the event of an emergency the member or members calling the meeting shall notify the news media and others that have requested notification immediately of the time, place and purpose of the meeting.
(c) Each public body shall issue an agenda for each meeting.
(1) Regular meeting agendas shall be available by 12:00 noon on the second day prior to the scheduled meeting day. Saturday and Sunday are not to be considered in this determination. Failure to include any item on an agenda does not preclude discussion or action upon that or any other item at a regular meeting.
(2) Special meeting agendas shall be available by 4:00 p.m. on the scheduled meeting day. Failure to include any item on an agenda does not preclude discussion or action on that or any other item at a special meeting.
(3) Emergency meeting agendas shall be available thirty minutes prior to the meeting at the meeting site. Discussion or action may be taken only upon items listed on the agenda.
(d) Meeting schedules and agendas shall be made available to any person upon written request to the Clerk of Council. These schedules and agendas shall be provided via U.S. Mail or fax at no charge within a fifty-mile radius. Requests for this information outside a fifty-mile radius will be reviewed on an individual basis to determine whether excess delivery costs will be incurred and should such be the case, these charges will be assessed to the requestor.
