The provisions of this section shall be applicable to certain lands which are within the current boundaries of Ward Five. In the City of Vermilion such lands are more particularly described in the legal description which is on file with the Clerk of Council of the City of Vermilion, excluding from that description, however, lands which are currently provided with water service by Vermilion.
With respect to such lands, the Council of the City of Vermilion by duly enacted ordinance or ordinances shall take, immediately upon the adoption of this section, any action necessary under Chapter 6119 of the Ohio Revised Code, and Section 6119.05 thereof, to make application for the inclusion of such lands in the regional water district operated or to be operated by the Erie/Huron County Rural Water Authority. The ordinance(s) shall further provide that the Erie/Huron County Rural Water Authority be permitted to use the existing casing pipe under State Route Two at Claus and Sunnyside Roads, for purposes of transporting water to such lands. The ordinance(s) required herein shall not be referred by Council to any of its Committee(s), shall not require three readings prior to passage and shall go into effect immediately upon passage.
If any conflict exists between other provisions of this Charter and this section, then this section shall prevail. If any individual provisions or requirements of this section are declared by judicial authority to be void or unenforceable, the remaining portions shall remain intact.
