1080.04 STORMWATER MANAGEMENT UTILITY ADVISORY COMMITTEE.
   (a)   Any person aggrieved or contesting a decision of the City Engineer under this section may appeal to the Stormwater Management Utility Advisory Committee. This Committee shall consist of a member of Council and five residents of the Municipality appointed by the Mayor and confirmed by City Council. To ensure a balanced committee, it is recommended that the Committee consist of no more than three residential homeowners or local business representatives at any one time. City Council will appoint a representative and an alternate to serve as non-voting members of the Advisory Committee. Decisions of the Advisory Committee are appealable to City Council. Any person aggrieved by a decision of City Council under this section may appeal to the Court of Common Pleas pursuant to Ohio R.C. Chapter 2506.
 
   (b)   Members so appointed shall serve at the pleasure of the Mayor for a term of four years. The Council member shall serve for the term of his or her office. Five members shall serve in overlapping terms, being appointed to serve for a four-year term. The composition of the first Advisory Committee will be one member appointed for one year, two members to serve for two years and two members to serve for four-year terms. It will be the responsibility of City Council to designate one of its members to serve as an advisory member of this Committee. The Advisory Committee shall meet quarterly each year and may meet as often as necessary at the discretion of the Committee. A quorum is necessary for the Committee to conduct official business. A quorum shall consist of a majority of voting members. The services of the City Engineer, Law Director, Director of Public Service, Safety Director, Utility Director, Building Inspector and Finance Director shall be available to the Advisory Committee.
   (c)   Any resident appealing a decision of the City Engineer to the Advisory Committee shall file an application for appeal with the Building Inspector and pay a non-refundable application appeal fee of twenty five dollars ($25.00). Other duties of the Advisory Committee shall be to review and promote public awareness of the progress and activities of the utility, to provide input as to needed projects and assist in prioritizing those projects and to make recommendations regarding proposals for amendments to this chapter.
