There is hereby levied and imposed upon all developed premises within the City of Vermilion just and equitable charges for the management of storm drainage services and a stormwater management utility.
(b) It is hereby determined that a property is furnished service in proportion to the amount of the property’s impervious surface area and stormwater runoff. All properties having impervious area within the City of Vermilion will be assigned an Equivalent Residential Unit or a whole multiple thereof, with all properties having impervious area being assigned at least one (1) ERU. The Storm Drainage Utility Rate shall be $5.50 per month per ERU. The maximum monthly charge for any commercial property shall be $30.00 per month for year 2017 and shall increase an additional $30.00 beginning January 1, 2018.
(1) Single-family residential units and two-family residential units shall be assigned one (1) ERU.
(2) Single unit condominiums with individual utility billings and apartments with individual utility billings shall be assigned one (1) ERU.
(3) Multi-family residential parcels will be assigned an ERU whole multiple based upon the property’s impervious surface area in square feet divided by 3,923 square feet (1 ERU). This division will be calculated to the first decimal place and rounded to the nearest whole ERU according to mathematical convention.
(4) Non-residential parcels will be assigned an ERU whole multiple based upon the property’s impervious surface area in square feet divided by 3,923 square feet (1 ERU). This division will be calculated to the first decimal place and rounded to the nearest whole ERU according to mathematical convention.
(c) The City Engineer is hereby authorized to evaluate the impervious surface area of all Multi-family residential parcels and non-residential parcels to establish charges for the stormwater utility. Rates shall be set by action of the City Council. In no year shall the operating fund of the utility show a loss. Owners that qualify under the City’s low income requirements for utility billing with the City will be exempt from the stormwater fee for residential use.
