For the purposes of this chapter, an "outdoor swimming pool" means any permanent or temporary water pool located out of doors which has a water surface greater than 100 square feet and which has a water depth at its deepest point of more than one foot, except for pools used for agricultural purposes in rural areas. The Building Inspector shall, upon request by an interested person, determine when a pool is used for agricultural purposes.
