For all outdoor swimming pools, a fence not less than three feet high nor more than six feet high must be erected so as to enclose the pool to prevent persons from falling into the pool. Any gate or opening in such fence shall be kept closed and locked when the pool is not in use. Any pool with a sidewall height of three feet or more above grade shall not require a fence so long as any ladder or access to the pool is affixed with a locking gate. All fences shall be constructed of a solid, rigid material and secured in a safe manner when the pool is not in use.
