1240.10 DEFINITIONS.
   As used in these Subdivision Regulations:
   (1)   "Alley" shall mean a street not more than twenty feet wide which affords only a secondary means of access to property abutting thereon.
   (2)   "Arterial street" (Major, Secondary, Primary, etc.) shall mean a public thorofare which is used primarily for fast or heavy traffic.
   (3)   "Auxiliary street" shall mean a public thorofare which carries traffic from minor streets to the major system of arterial streets and highways, including the principal entrance streets of a residential development and streets for circulation within such a development.
   (4)   "Average width" shall mean the distance measured between the midpoint of the sides of a lot. When the two sides are not straight, the City Planning Commission shall determine the average width.
   (5)   "City Planning Commission" or "Commission" shall mean the duly appointed Planning Commission of the City of Vermilion, which controls the platting of land within the corporate limits of the City or within a distance of three miles of the corporate limits when a plan for such area, as provided for in Ohio R.C. 711.09, has been adopted.
   (6)   "Comprehensive (General or Master) Plan" shall mean the Plan made and adopted by the City Planning Commission, and hereafter amended and supplemented, indicating the general locations recommended for the principal streets, parks, public buildings, zoning districts, character and extent of community development and other physical aspects of urban and rural planning, or portions thereof, on file in the offices of the Recorder of Lorain County, the Recorder of Erie County and the City Planning Commission.
   (7)   "Crosswalk" shall mean a right of way, twenty feet or more in width, which cuts across a block to facilitate pedestrian access to adjacent streets and properties.
   (8)   "Developer" shall mean any person, partnership or corporation, or duly authorized agent thereof, who constructs or contracts to construct improvements on subdivided land.
   (9)   "Easement" shall mean a right to some profit, benefit or use out of or over the land of another, created by grant or prescription.

   (10)   "Engineer" shall mean a registered professional engineer authorized to practice engineering, as defined by Ohio R.C. Chapter 4733.

   (11)   "Flood plain" shall mean that portion of a river or creek valley adjacent to the river or creek channel, which is covered with water when the river or creek overflows its banks at flood stage.
   (12)   "Improvements" shall mean street pavements with or without curb or gutter, sidewalks, crosswalks, water mains, sanitary and storm sewers and street trees.
   (13)   "Inspection fee" shall mean the cost to the City of Vermilion, and to Erie County and Lorain County, if they are involved, of supervising construction, to be paid by the subdivider or developer.
   (14)   "Key (Location) Map" shall mean a drawing at a reduced scale located on the plat which shows legibly, by dimension and/or other means, enough area beyond the bounds of the proposed subdivision to locate and orient the subdivision within the City and the relationship of the site to the community facilities which serve or influence the property.
   (15)   "Lot" shall mean a parcel of land fronting on a street or occupied or intended for occupancy by one main use or by one main building with its accessory buildings and uses, including such open spaces as are arranged and designed to be used in connection with such buildings. A lot may be a unit of land described by metes and bounds.
(a)   "Sublot," "part of a sublot," "parts of sublots" or "more than one sublot," in a recorded subdivision, or any combination of these, shall mean a parcel of land having frontage on one street only, unless it is a corner lot, and used for one purpose.
(b)   "Depth of lot" shall mean the mean distance from the street line of the lot to its rear line measured in the mean direction of the side lines of the lot.
(c)   "Width of lot" shall mean the mean width measured at right angles to its depth.
(d)   Any "side lot line" not a front line or a rear line shall be deemed a "side line."
(e)   "Corner lot" shall mean a lot at the point of intersection of and abutting on two intersecting streets, each more than twenty feet wide, the angle of the intersecting street lines at their points of intersection being not more than 135 degrees. It shall mean the land occupied or to be occupied by the corner building and the accessory buildings and yards, if any.
(f)   "Side line of a corner lot" shall mean the line along the narrower or less important street, unless the lot is a sublot in a recorded subdivision and is clearly intended to front on the narrower street.
   (16)   "Marginal access street" shall mean a minor street which is generally parallel and contiguous to an expressway, freeway, parkway or major or minor street, and which is designed to intercept, collect and distribute traffic desiring to cross, enter or leave such traffic artery, and which provides access to abutting properties and protection from through traffic.
   (17)   "Minor street" shall mean public streets which are used primarily for access to the abutting properties. (Ord. 850. Passed 7-1-63.)
   (18)   "Official Thorofare Plan" shall mean the system of streets for the City of Vermilion and the three-mile limit, as adopted by the City Planning Commission and Council, on file in the offices of the Recorders of Lorain and Erie Counties, Ohio, and in the offices of the City Planning Commission, together with all amendments thereto subsequently adopted.

   (19)   "Performance bond" or "surety bond" shall mean a personal or corporate surety-ship agreement between a subdivider and such surety in favor of the City of Vermilion, or the Board of County Commissioners, if they are involved, guaranteeing the completion of physical improvements according to plan and specifications within the time prescribed by the subdivider's agreement.
   (20)   "Plat" shall mean a map upon which the subdivider's plan of the subdivision is presented and which he submits for approval and intends to record in the final form.
   (21)   "Regulations" shall mean the Subdivision Regulations for the City of Vermilion, Ohio.
   (22)   "Reproducible tracing" shall mean a translucent reproduction of the original tracing on mylar, from which prints may be directly taken.
   (23)   "Road or street right of way" shall mean the width, between property lines, of a street, alley, crosswalk or easement.
   (24)   "Subdivider" shall mean any person, firm or corporation, or duly authorized agent thereof, who undertakes the subdivision of land as defined in paragraph (26) hereof.
   (25)   "Subdividers-developers agreement" shall mean an agreement by and between a subdivider and/or developer and the City of Vermilion and the Board of County Commissioners, if they are involved, that sets forth the manner in which the subdivider and/or developer agree to proceed with the construction of public improvements and the disposition of lots in the subject subdivision.
   (26)   "Subdivision," in accordance with Ohio R.C. 711.001, shall mean:
(a)   The division of any parcel of land, shown as a unit or as contiguous units on the last preceding tax roll, into two or more parcels, sites or lots, any one of which is less than five acres, for the purpose, whether immediate or future, of transfer of ownership, provided, however, that the division or partition of land into parcels of more than five acres not involving any new streets or easements of access, and the sale or exchange of parcels between adjoining lot owners where such a sale or exchange does not create additional building sites, shall be exempted; or
(b)   The improvement of one or more parcels of land for residential, commercial or industrial structures or groups of structures involving the division or allocation of land for the opening, widening or extension of any street or streets, except private streets serving industrial structures; the division or allocation of land as open spaces for common use by owners, occupants or lease holders or as easements for the extension and maintenance of public sewer, water, storm drainage or other public facilities.
   (27)    "Subdivision Regulations" shall mean Ordinance 850, passed July 1, 1963, as amended, codified herein as Title Four of Part Twelve - the Planning and Zoning Code.
   (28)   "Surveyor" shall mean a registered surveyor, as defined by the Registration Act of the State of Ohio.
