The Mayor and the Director of Public Service are hereby authorized to furnish fuel and lubrication products only to "mini buses" operated by Vermilion Community Services, Inc., a nonprofit Ohio corporation, under the following terms and conditions:
(a) All of such products will be used solely for the purpose of providing public mass transportation services to senior citizens or the enfeebled of this community and not for private gain or usage.
(b) The operations of such corporation remain genuinely nonprofit.
(c) The "mini bus" transportation program is operated and managed totally by such nonprofit corporation and in an effective and meaningful manner.
(d) All senior citizens and the enfeebled of this community will be so served without any type of discrimination or classification so that the program remains genuinely available to the public.
(e) The contribution to such program by the City is wholly elective and voluntary and the City is understood to be a donor only. Such program has no City direction and exists independently of the City.
(f) For good cause, the Mayor or Council may elect not to further participate in such program but in such case shall give the corporation sixty days prior notice of City termination stating the reason(s) therefor. What constitutes "good cause" shall be determined solely by the City.
(g) The City and the corporation shall both maintain gallonage and odometer records for products furnished under this chapter.
