1030.05 RETAINING WALLS.
   When it is found necessary to grade a lot to a higher or lower finished grade than the natural grade or adjoining property on the sides and to the rear of such lot, it shall be incumbent upon the owner of such lot to get permission from the City Engineer to change to a higher or lower finished grade. It shall further be incumbent upon the owner of the lot to provide suitable retaining walls or other approved protection on his or her property to protect adjacent property and structures from the draining of surface waters or damage, and further, to protect the adjacent property and structures from caving of earth and to assist in the maintaining of the existing natural grade of such property. An approval from the City Engineer is required prior to construction of any new retaining wall higher than three feet above the lowest grade or repairs to any existing retaining wall higher than three feet above the lowest grade. Plans, prepared and stamped by a registered design professional, shall be submitted for review. The fee for such review and permit issuance shall be three hundred dollars ($300.00).
