(a) No person shall dig, trench, excavate, grade, tunnel or do any work in, over or under any public street, sidewalk or other public ground in the City without first obtaining a permit therefor from the Director of Public Service. The fee for such permit shall be fifty dollars ($50.00).

(b) No person shall construct or cause to be constructed a private street (including a street exempted from Subdivision Regulations per Section 1222.11), way, road, roadway, lane, walkway, path, sidewalk or any other type of accessway for either vehicular or pedestrian movements which is designed to serve more than one parcel of real estate, whether wholly within the corporate limits or constructed in part from outside the corporate limits to a point of tangency within the corporate limits, so as to cause such accessway to either intersect or otherwise become an extension or appendage of a duly dedicated public highway or street, until and unless:
(1) Approval for the construction, extension, intersection or attachment to the dedicated public roadway has first been officially granted by the Planning Commission. The Commission shall verify to the Director of Public Service that such accessway is deemed compatible with the Official Thoroughfare Plan of the City as determined by the Commission, that the general plan and materials utilized in the construction of such accessway are compatible with the future growth and planning of the community in the specific area in question and that the materials utilized in constructing such accessway are likewise compatible with any future development in the specific area in question, using street construction standards adopted in Chapter 1232 as a guideline for making such determination.
(2) He or she obtains a street opening permit from the Director of Public Service as referred to in subsection (a) hereof.
