(a) Between the hours of 8:00 p.m. and 6:00 a.m. of the following day, the sound pressure level dB(A), at the point of measurement, radiating from any activity located within the City, whether open or enclosed, shall not exceed fifty decibels or the average sound level of the street traffic noise nearest the noise generator, whichever is higher.

(b) Whoever fails to comply with this section is guilty of a misdemeanor of the third degree. A separate offense shall be deemed committed each day during or on which a noncompliance occurs or continues. The penalty shall be as provided in Section 698.02.
