§ 71.01 PURPOSE, DISCLAIMER, AND ASSUMPTION OF RISK.
   (A)   Purpose. The purpose of this chapter shall be to establish a golf cart chapter within the Town of Varnamtown to promote the health, safety and welfare of persons operating cart(s) within the Town of Varnamtown and to protect the safety of their passengers and other users of the roads.
   (B)   Disclaimer. Golf carts are not designed or manufactured to be used on the public streets and the town in no way advocates or endorses their operation on public streets or roads. The town, by regulating this operation, is addressing obvious safety issues, and adoption of this chapter is not to be relied upon as determination that operation on public streets is safe or advisable if done in accordance with § 71.03. The town has no liability under any theory of liability and the town assumes no liability for permitting golf carts to be operated on the public streets and roads under the special legislation granted by the state legislature.
   (C)   Assumption of risk. Any person who owns, operates or rides upon a golf cart on a public street, road or highway within the Town of Varnamtown does so at their own risk and peril, and assumes all liability resulting from the operation of the golf cart and must be observant of and attentive to the safety of themselves and others, including their passengers, other motorists, bicyclists and pedestrians.
