§ 152.086 DESIGN STANDARDS.
   (A)   Design standards for public streets. All public streets delineated as such on the final plat shall have a minimum right-of-way of 60 feet. All private streets, delineated as such on the final plat shall have a minimum right-of-way of 30 feet, unless it is a thoroughfare in which case it too shall be a minimum of 60 feet in width. For purposes of this chapter, all subdivisions must have at least one thoroughfare, and it shall be a street that provides access into the subdivision from the public road if such public road bears S.R., N.C., or U.S. designation. Further, any street that ties into a state road must meet state requirements.
   (B)   Design standards for stormwater drainage. Adequate drainage subdividers shall provide an adequate system for the proper drainage of all surface and subsurface water. The design of such a system shall be certified by the County Soil and Water Conservation District as herein before required.
   (C)   Place of monuments. In accordance with G.S. Chapter 39, Article 5-A of the permanent markers shall be placed at one or more corners of the subdivision to be designated as control corners. In addition, permanent markers shall be placed at the intersection of centerlines, offset lines, points of curvature, or other control points within or on the right-of-way lines of two or more streets. The permanent markers shall be of such material and affixed to the earth in such a manner as to ensure as great a degree of permanence as is reasonably practical.    (D)   Design standards.
      (1)   General design. All major subdivisions shall be designed so as to minimize flood damage to any lots, buildings, or other facilities within the development.
         (a)   Minimum lot size. Minimum lot size shall be one-half acre (21,780 square feet).
         (b)   Building setback lines. All major subdivisions shall show minimum setback lines as follows:
            1.   Front yard: 50 feet;
            2.   Side yard: ten feet;
            3.   Street side yard, (corner lot): 15 feet; and
            4.   Rear yard: five feet.
         (c)   Height. Structures erected on waterfront property shall be limited to height of not more than 36 feet from the average ground level of the lot on which the structure is erected.
      (2)   Utilities.
         (a)   All utilities in a subdivision that include water systems, stormwater systems, sanitary sewerage systems, gas lines, and electrical distribution facilities, shall be designed and constructed so as to minimize flood damage to those facilities.
         (b)   All water supply and sewerage systems within a proposed major subdivision shall be designed so as to eliminate infiltration of flood waters into the systems and eliminate discharge from the systems into flood waters.
         (c)   Any on site waste disposal system shall be located so as to avoid impairment of the system or contamination from the system during flooding.
      (3)   Erosion and sediment. All major subdivisions shall be designed and constructed in compliance with G.S. Chapter 113A, Article 4 (Sedimentation Pollution Control Act of 1973).
