§ 76.99 PENALTY.
   (A)   Whoever violates any provision of this chapter for which no penalty otherwise is provided in the section is guilty of 1 of the following:
      (1)   A minor misdemeanor;
      (2)   If, within 1 year of the offense, the offender previously has been convicted of or pleaded guilty to 1 violation of this chapter, a misdemeanor of the fourth degree;
      (3)   If, within 1 year of the offense, the offender previously has been convicted of or pleaded guilty to 2 or more violations of this chapter, a misdemeanor of the third degree.
   (B)   Whoever is convicted of or pleads guilty to a misdemeanor or minor misdemeanor shall be sentenced in accordance to § 130.99.
