§ 36.09 CITY “PICK-UP” OF EMPLOYEE CONTRIBUTIONS TO THE PUBLIC EMPLOYEES RETIREMENT SYSTEM AND POLICE AND FIREMAN’S PENSION FUND.
   (A)   The full amount of the statutorily required contribution to the Public Employees Retirement System of Ohio and the Police and Fireman's Pension Fund shall be withheld from the gross pay of each Van Wert City elected official, Board, Judge, or other appointing authority and shall be "picked up" (assumed and paid to the Public Employees Retirement System and Police and Fireman's Pension Fund) by the City of Van Wert. This "pick up" by the City of Van Wert is and shall be designated as public employee contributions and shall be in lieu of contributions to the Public Employees Retirement System of Ohio and Police and Fireman's Pension Fund by each such person or employee. No person subject to this "pick up" shall have the option of choosing to receive the statutorily required contribution to the said Public Employees Retirement System or Police and Fireman's Pension Fund instead of having it "picked up" by the City of Van Wert or of being excluded from the "pick up".
   (B)   The City of Van Wert and the Auditor thereof, shall, in reporting and making remittance to the Public Employee Retirement System of Ohio and the Police and Fireman's Pension Fund, report that the public employee's contribution for each person subject to the "pick up" has been made by the City of Van Wert in lieu of contributions to said Public Employees Retirement System and Police and Fireman's Pension Fund by each such person and that such contributions are designated as public employee contributions.
