§ 98.05 TREE OR SHRUB NUISANCES.
   (A)   Any tree, shrub, or part thereof growing upon private property but overhanging or interfering with the public use of any public street, way, alley, sidewalk, or walkway in the city, or which in the opinion of the Director of Public Safety and Service endangers the life, health, safety, comfort, and property of the public because of its diseased condition, is hereby declared to be a public nuisance.
   (B)   Trees and shrubs shall be kept trimmed in order not to extend onto any public sidewalk or walkway and the limbs of any tree along and overhanging any public sidewalk or walkway shall be kept trimmed to no closer than 12 feet above the sidewalk or walkway.
   (C)   Trees and shrubs shall be kept trimmed in order not to extend onto the right-of-way of any public alley or way and the limbs of any tree along and overhanging any public alley or way shall be kept trimmed to no closer than 15 feet above the surface of the public alley or way.
   (D)   Trees and shrubs shall be kept trimmed in order not to extend onto any public street or way; limbs of any tree along and overhanging any public street or way shall be kept trimmed to no closer than 15 feet above the surface of the public street or way.
   (E)   Any tree or its roots causing any public sidewalk or walkway to hover that would endanger or cause any person or persons to stumble shall be considered a public nuisance.
