(A) The city may require improvements to private sewers to reduce infiltration or inflow or require a sewage meter be installed to meter the infiltration to determine an accurate sewage charge. The cost of the system improvements and meter shall be the expense of the private system owner. If upon examination and verification by the city, the infiltration that the private system is delivering to the public sewer exceeds 2,000 gallons per day per inch diameter per mile of pipe infiltration, the city can require the owner to make the necessary repairs to the private system.
(B) Failure to make the repairs within a reasonable time will result in penalty charges levied against the private system owner to the maximum extent allowed by law. This penalty shall be considered a lien upon the property involved and if not paid on demand by the city, the same shall be certified to the County Auditor to be placed upon the duplicate, or shall be otherwise collected. All sources of inflow to the system are expressly prohibited from discharging to the sewer system.
