1484.05 OWNER ACTION AFTER HEARING NOTICE.
   (a)   On being served the hearing notice the owner or other person with a recorded interest in the property may within fifteen days after service of notice, make application in writing to the Code Official and Chief Building Official for a building permit to undertake the repairs or replacement of items found to constitute a public nuisance.
      (1)   The owner shall within such time, or such additional time, not to exceed forty-five days, as the Code Official may deem necessary provide adequate plans and specifications as required by the Chief Building Official, covering the repairs or replacements.
      (2)   The Chief Building Official shall, on approval of the plans and specifications, cause a building permit to be issued to the owner. Notwithstanding the issuance of a building permit for a period longer than ninety days, the owner shall have ninety days to effect and complete the repairs or replacements. If such building permit is issued, at the scheduled hearing for nuisance and abatement, the City shall cause the hearing to be tabled during such ninety-day period as may be extended.
      (3)   The Code Official or Chief Building Official may grant an extension to the ninety day period in subsection (a)(2) above if prior to the expiration of the ninety day period, the owner request such extension in writing and shows reasonable cause for the requested extension and the extension will more readily effect the repairs and/or replacements.
      (4)   Whenever permits are issued for repairs to the plumbing, electrical, heating and air conditioning, or similar systems in a nuisance structure, such permits shall be valid for a period of time not to exceed the unexpired term of the building permit, or extension thereof, notwithstanding any other provision of this Code to the contrary.
   (b)   On being served the hearing notice, the owner may within fifteen days after service of hearing notice, make application in writing or in person to the Code Official for a demolition permit to abate the nuisance completely by demolition and removal of the structure. Within thirty days of the issuance of the demolition permit the owner shall completely demolish and remove the entire building including basement and foundation walls where practical, and including any accessory structures, if prior to the expiration of the thirty-day period, the owner request such extension in writing and shows reasonable cause for the requested extension the Code Official may grant an extension to the demolition permit. If a demolition permit is issued, the hearing shall be tabled during such thirty-day period. If such demolition permit is issued, at the scheduled hearing for nuisance and abatement, the City shall cause the hearing to be tabled during such thirty-day period as may be extended.
   (c)   On being served the hearing notice, the owner may within fifteen days after service of notice, request a continuance of the hearing not to exceed fourteen days.
   (d)   Any abatement by the owner upon the issuance of a building permit under division (a) of this section or a demolition permit under division (b) of this section, shall be complete within the time prescribed in the applicable section above.
