(a) Determinations by the Chief of Police regarding a notice of revocation, a grant or refusal to renew a shooting permit or the grant or denial of an initial application for a shooting permit may be appealed to the City Manager.
(b) Within ten days of receipt of a notice of revocation/notice of refusal to renew a permit or denial of an initial application, an aggrieved party may request a hearing before the Vandalia City Manager to examine evidence and provide rebuttal of any findings and the City Manager shall serve as a finder of fact with authority to uphold or overturn the findings of the Chief of Police. Any such hearing request must be in writing, delivered to the City Manager at 333 James Bohannan Dr., Vandalia, Ohio and clearly have the name and location of the shooting range or proposed shooting range (as the case may be), name and signature of the aggrieved party, and the basis of the appeal.
(c) Upon receipt of a written request for hearing, the City Manager shall set a hearing date which shall occur within fourteen days of the receipt of the written hearing request, be held at Vandalia City Hall, and such date and time shall be delivered to the holder of the shooting range permit, or applicant for such permit (as the case may be).
(d) At the hearing, both the holder of the shooting range permit and the Chief of Police shall have the opportunity to call witnesses, to present evidence and to examine witnesses under oath. Either side may be represented by legal council.
(e) The City Manager shall issue a final determination within five days of the hearing.
