1482.13   RUBBISH AND GARBAGE.
   (a)   Accumulation of Rubbish or Garbage. All exterior property and premises, and the interior of every structure shall be free from any accumulation of rubbish or garbage. The interior and exterior of every structure shall be free from any undue accumulation of rubbish or garbage to avoid detrimental effects on the physical or mental health of occupants or users of the premises and to avoid significant adverse impacts upon the value of the property, since that would, in turn, negatively impact upon the value of neighboring properties and the quality of life throughout not only the neighborhood.
    (b)   Disposal of Rubbish. Every occupant of a structure shall dispose of all rubbish in a clean and sanitary manner by placing such rubbish in approved containers.
   The owner of every occupied premises shall supply approved covered containers for rubbish, and the owner of the premises shall be responsible for the removal of rubbish.
    (c)   Disposal of Garbage. Every occupant of a structure shall dispose of garbage in a clean and sanitary manner by placing such garbage in an approved garbage disposal facility or approved garbage containers.
      (1)   Garbage facilities. The owner of every dwelling shall supply one of the following:
         A.   An approved mechanical food waste grinder in each dwelling unit;
         B.   An approved incinerator unit in the structure available to the occupants in each dwelling unit; or
         C.   An approved leakproof, covered, outside garbage container.
      (2)   Containers. Every owner, occupant, tenant or lessee owning, using, occupying or leasing any building or structure for church, school, commercial, industrial, institutional or dwelling purposes, provided the dwelling structure does not contain more than three dwelling units, shall provide and maintain garbage cans and receptacles of sufficient number and type as specified herein, to contain the garbage and trash that will accumulate on the premises. The receptacle shall be constructed of metal or its equivalent, shall be of substantial weatherproof material, shall have two handles on the body of the container and shall have a capacity of not less than ten gallons nor more than thirty gallons. All such receptacles used to contain garbage shall have a tight fitting lid or cover, which cover shall be kept secure and fastened so as to prevent the entry of flies at all times when garbage is stored and in the receptacle.
   Every apartment building or structure containing four or more dwelling units used for residential purposes shall place garbage and refuse in containers of a type and description as may be required by the City.
      (3)   Placement of containers. All approved garbage containers, including receptacles, cans and plastic bags, shall be placed at the curb for pick-up. No such garbage receptacle shall be placed at the curb prior to 12:00 noon on the day preceding the pick-up and all containers shall be moved from the curb by 6:00 p.m. of the day following the scheduled pick-up day. When not at the curb for pick-up, all trash and garbage receptacles shall either be in an enclosed building or placed behind the front building line. Dwelling units containing four or more units which use unitized single containers provided by the City, or where a fee has been paid for off-curb refuse collection, shall be exempt from this section.
   All garbage containers for dwelling units where the owner has paid the off-curb pick-up fee shall be placed for collection so that the collector is not required to go more than ten feet beyond the rear line of the principal building for collection purposes. In the case of buildings containing three or fewer dwelling units, the collector shall, in no event, be required to go more than seventy feet from the right of way for collection purposes. In no event shall the collector be required to enter garages, carports, breezeways, fenced rear yards or other structures to make collection. If it is not practical to place containers for collection as specified in this section, the Code Official, with the concurrence of the collector, shall determine the location of containers.
