1464.05   CONTINUATION OR REMOVAL OF EXISTING ENCROACHMENTS.
   Encroachments upon a public right of way for streets, alleys and sidewalks, which encroachments exist on the effective date of this section (Ordinance 75-22, passed July 7, 1975), shall be permitted to remain without a permit until such time as more than fifty percent of the encroachment is destroyed by fire, wind or storm, the encroachment is demolished or removed, or more than fifty percent of the encroachment is reconstructed or remodeled. Upon the occurrence of any of these contingencies, the encroachment shall be removed from the public right of way within thirty days, unless a revocable permit is issued pursuant to the provisions of this chapter.
