1028.02   DUTIES OF OWNERS.
   Any person growing a tree within a public highway or responsible for trees growing on property abutting on public places supporting trees or plants shall:
   (a)   Trim. Trim his or her trees so as not to cause a hazard to public places or interfere with the proper lighting of public highways by street lights, and so that a minimum clearance of any overhead portion thereof shall be eight feet above the surface of the street or right of way. Such person shall remove all dead, diseased or dangerous trees or broken or decayed limbs which constitute a menace to the safety of the public. The City may trim any tree or shrub on private property when it interferes with vehicular and/or pedestrian traffic in public places, with the proper spread of light along the street from a street light or with visability of any traffic control device or sign. Such trimming shall be confined to the area immediately above the right of way. The cost of such trimming shall be assessed to the abutting property owner in accordance with Chapter 676 of these Codified Ordinances.
   (b)   Treat or Remove. Treat or remove any tree or plant so diseased or insect-ridden as to constitute a hazard to trees or plants in public places; and
   (c)   Prohibited Species. Refrain from planting any of the prohibited species set forth in Section 1028.01(a).
