1022.01   REPLACEMENT OF SIDEWALKS; SPECIAL ASSESSMENTS.
   (a)   The basic responsibility for the replacement of a sidewalk shall be that of the property owner whose land abuts such sidewalk. With the exception of the corner extensions or sidewalks directly damaged by City work, which damage shortened the normal life expectancy of the sidewalk, all costs for sidewalk removal and replacement shall be assessed to the property owner.
   (b)   Sidewalks shall be replaced each year on a City-wide basis, with that sidewalk which is in the poorest condition being scheduled for replacement, regardless of the area in which it is located.
   (c)   A property owner whose sidewalk is scheduled for replacement shall be advised of the need for replacement and shall be given the opportunity to arrange for his or her own contractor or to do this replacement himself or herself prior to the work being done by special assessment through a City contractor. When practical, the property owner shall be advised of the cost of having this work done by special assessment so that the property owner may determine which method of replacement is in his or her best interest.
   (d)   Special assessments for sidewalk replacement shall be spread over a five-year period, with an interest rate equal to the interest rate for bonds, if such bonds were issued for the replacement project. (Res. 84-R-ll. Passed 4-16-84.)
