§ 71.02 DEFINITION.
   For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
   ONE WHO OPERATES A VEHICLE hereinabove described or who acts as an OPERATOR OF A VEHICLE. A person in actual physical control of a vehicle which is in motion or which has the engine running. The terms OPERATOR and DRIVER and their cognates are synonymous.
