Where in its opinion a waiver will result in equal or better performance in furtherance of the purposes of this chapter, or where strict adherence to the provisions of this chapter would cause an unnecessary hardship due to topographical or other conditions peculiar to the site, or where, through an unintentional error by the applicant, his or her agent, or the reviewing staff, there is a minor violation of a standard in §§ 155.015 et seq., where the violation is not prejudicial to the value or development potential of the subdivision or adjoining properties, the Planning Board may approve a waiver or a waiver with conditions when the approval will result in meeting the intent of this chapter.
