(A) The Parks and Recreation Commission shall have the right to designate operating hours for the facilities, but the Park Supervisor and the lifeguards under his or her supervision shall be responsible for determining when the swimming facilities are open during those hours.
(B) The lifeguards shall have the right to keep all persons out of the water at any time that they deem the same to be in the interest of safety or in the best interest of the operation of the facility; they shall have the further right to require all persons to leave the water for accounting for those persons present at any time they deem the same to be expedient.
(C) They have the right to restrict certain areas at times for use by classes of instruction.
(D) They shall have the right to require reasonable swimming tests for any individual swimmer or group of swimmers before they are allowed to use the facilities and shall have the further right to limit any individual swimmer to certain areas of the swimming facilities in accordance with their sole judgment of that swimmer’s abilities.
