§ 50.17 LIABILITY AND OWNERSHIP OF MAINS, SERVICES AND FIXTURES.
   (A)   The Department of Water Works shall maintain specifications and standards for all mains, connection services and valves within the public water supply system. Plumbing and fixtures shall be regulated by the city building bodes, cross connection regulations and appropriate state codes. The Department of Water Works owns and operates all water mains and services between and including the main and curb box shut-off valve. In addition, the Department of Water Works shall own the water meter and meter reading devices installed within the building, dwelling or premises.
   (B)   The property owner owns and has liability for the water connection service from, and excluding, the curb box shut-off valve to the building or structure.
   (C)   The Department of Water Works shall not be liable for any damages caused by a leak or break in any private part of the water connection service. The costs associated with the repair and/or replacement of any portion of the private part of the water connection service shall be paid by the property owner, including any additional water usage resulting from the occurrence.
   (D)   The Department of Water Works shall not be responsible for any damage to buildings, trees or other obstructions within Department of Water Works easements and/or public rights-of-way that may result from work being performed in the easements and/or public rights-of-way by the Department of Water Works.
   (E)   If a leak develops in the water service while a party is performing work on a water service, it shall be the responsibility of the person causing the leak to repair the item at his or her expense in a timely manner.
