§ 50.09 CROSS CONNECTIONS.
   (A)   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CROSS CONNECTION. Any physical arrangement, including cross connection control devices or backflow prevention devices not in working order, whereby the public water supply distribution system is directly connected, either continuously or intermittently, with any secondary source of water supply, sewer, drain, conduit, pool, piping, storage reservoir, plumbing fixture or other device which contains, or may contain, and is capable of imparting to the public water supply, contaminants, contaminated water, sewage, storm water or other waste of liquid of unknown or unsafe quality.
   (B)   Pursuant to the provisions of 327 IAC 8-10-1, cross connections between potable water systems and other systems or equipment containing water or other substances are prohibited, except when and where approved by the Department of Water Works, suitable protective devices such as appropriate back flow prevention devices or equal are installed, tested and maintained to ensure proper operation on a continuing basis. It shall be the responsibility of each water supply user and/or other property owner to meet these requirements at the user’s and/or property owner’s expense.
   (C)   In order to protect the public water system from contamination due to contaminants through the water service connection into the public water system, a program of regulation, testing and inspection shall be adopted by the Department of Water Works.
   (D)   The plumbing in every building or premises served by the Department of Water Works shall be inspected by a qualified plumber who is an IDEM certified cross connection inspector and the plumber/inspector shall provide a written report of the inspection as required by the Department of Water Works.
   (E)   The General Manager or his or her designated agent shall have the right-of-entry into every building or premises served by the Department of Water Works during reasonable hours for the purpose of making inspection of plumbing systems connected to the public water supply. Refusal to allow inspection of a building or premises is cause for requiring the installation of a maximum hazard backflow prevention device at the owner’s expense, or discontinuation of public water supply service.
