§ 35.36 STATE BUSINESS PREFERENCE.
   (A)   An offeror is a state business if it has its principal place of business operations in the state; is incorporated in the state; or its primary owners are residents of the state. The Purchasing Agent may
develop criteria for establishing qualifications for state businesses and if the Purchasing Agent does so it shall be done by resolution.

   (B)   The Purchasing Agent may make the determination that certain states have business preferences that are unfavorable to the state, and if this determination is made it shall be made in writing by resolution.

   (C)   The Purchasing Agent shall develop rules and regulations for calculating state business preferences pursuant to this subchapter, and shall do so by resolution.
