TO: The Board of Public Works and Safety and the Common Council of the City of Valparaiso and the City of Valparaiso
The undersigned respectfully represent that they are the owners of certain real estate located within the existing corporate boundaries of the City of Valparaiso and which real estate is legally described as follows, to-wit:

That in consideration of the waiver of the requirements of the installation of sidewalks serving the above premises before any structure is occupied thereon as granted by the Board of Public Works and Safety of the City of Valparaiso, Indiana, we agree in our own behalf and in behalf of our heirs, executors, administrators, assigns, grantees and successors in title that when and if the said Board of Public Works and Safety proposes an improvement project ordering the installation of sidewalks to serve said premises and the levying of assessments for the payment thereof, we will not object or remonstrate against such improvement project nor protest against the carrying out of said project nor bring any action at law or in equity to restrain or stop the consummation of said project.
This Agreement shall be covenant running with the land.
