§ 71.16 STOPPING AT RAILROAD CROSSINGS; PROCEDURE FOR CROSSING.
   Whenever a person who drives a vehicle approaches a railroad grade crossing, the person shall stop within 50 feet but not less than 15 feet from the nearest track of the railroad, and may not proceed until the person can do so safely under the following circumstances:
   (A)   When a clearly visible electric or mechanical signal device gives warning of the immediate approach of a train;
   (B)   When a crossing gate is lowered or when a human flagman gives or continues to give a signal of the approach or passage of a train;
   (C)   When a railroad train approaching within 1,500 feet of a highway crossing emits an audible signal and because of speed or nearness to the crossing is an immediate hazard; and/or
   (D)   When an approaching train is plainly visible and is in hazardous proximity to the crossing.

   (E)   When a stop sign is erected at a railroad crossing, the driver of a vehicle shall stop within 50 feet but not less than ten feet from the nearest track of the grade crossing, and shall proceed only upon exercising due care.

   (F)   (1)   This division does not apply to the following:
         (a)   A street railway grade crossing within a business or residence district; or
         (b)   Abandoned or unused tracks.
      (2)   The following vehicles shall adhere to the provisions of this division:
         (a)   A motor vehicle carrying passengers for hire;
         (b)   A school or private bus that is carrying passengers; or
         (c)   A vehicle carrying explosive substances or flammable liquids as a cargo or part of the cargo.
      (3)   These types of vehicles listed in subsection (2) above shall, before crossing at grade a track of railroad, stop the vehicle not more than 50 feet and not less than 10 feet from the nearest rail of the railroad.
      (4)   While stopped in accordance with subsection (3) above, the person shall do the following:
         (a)   Listen through an open window or door;
         (b)   Look in both directions along the track for an approaching train and for signals indicating the approach of a train;
         (c)   Not proceed until the person can proceed safely. After stopping, the person shall cross only in a gear of the vehicle so there will be no necessity for changing gears while traversing the crossing. The person who drives the vehicle may not shift gears while crossing the track or tracks; and
         (d)   If a police officer or traffic-control signal directs traffic to proceed at a railroad crossing, the person who drives a vehicle subject to this section shall proceed in accordance with the instructions of the police officer or traffic-control signal.
