§ 72.70 EAST GATE PARKING AREA.
   (A)   Eligibility for East Gate Area parking permit.
      (1)   Any property owner who resides within the area identified in Exhibit "A", which is attached to Ord. 16, 2009 and incorporated herein by reference, possessing a valid driver's license and automobile registration, may apply to the Board of Works for a parking permit for one parking space in the East Gate Parking Area, as defined by Exhibit "B" ("East Gate Parking Area"), which is attached to Ord. 16, 2009 and incorporated herein by reference, commencing August 14, 2009 and each succeeding year on August 14, except should August 14 be a weekend or holiday recognized by the Council, than the next business day shall apply. The submittal of a permit application by any such resident does not guarantee the approval of the same.
      (2)   The owner of a multiple residential unit structure within the designated East Gate Parking Area Parking Area that applies for multiple parking permits for use by tenants must secure a permit application from each recipient of a permit and maintain a record of each permit application. Attached to Ord. 15-2018 as Exhibit A, and incorporated herein by reference, is a form permit application. Upon request by the city, a copy of any such permit application shall be provided to the city at no charge. Renewal of permits to owners of a multiple residential unit structure within the designated East Gate Parking Area need not be approved by the Board of Works.
      (3)   Except as provided in division (A)(2), no more than one permit can be registered to the same address/unit at any given time.
   (B)   (1)   The City's Board of Public Works shall adopt a permit application to be completed by all applicants. Such permit application shall include a request for following information:
         (a)   The applicant's name and address;
         (b)   The year, make, and license plate number of the permitted vehicle;
         (c)   A signed acknowledgment of the applicant that he/she resides at the address given in the permit application;
         (d)   Certify that applicant has no outstanding unpaid city parking violation and will timely pay any city parking violation while issued a permit;
         (e)   Payment of the appropriate registration fees which is non-refundable; and
         (f)   A copy of the applicant's license and vehicle registration.
      (2)   Should any information on the permit application change while a permit is active, the applicant shall provide written notice of such change to the city.
   (C)   Parking permit hang tag required.
      (1)   The tag shall be placed on the vehicle's rearview minor at all times when a vehicle is parked in either the East Gate Parking Area Parking Area and be clearly visible from outside the vehicle. Nothing in this provision shall prohibit the city, acting through the Board of Works, from reverting back to the use of parking decals.
      (2)   All administrative functions relating to the issuance of permits shall be handled by the Clerk-Treasurer.
      (3)   Tags shall be designated separately for the East Gate Parking Area and University Promenade Parking Area. Tags for one area shall not authorize parking in another area.
      (4)   The fee for an annual tag shall be $250. There shall not be any administrative fees or renewal fees. The replacement fee for a lost tag shall be $100 if replacement tags are available. No replacement tags shall be issued prior to December 1.
   (D)   Expiration/renewal of permits.
      (1)   All permits shall expire on July 31 of each year.
      (2)   Any resident or owner possessing a valid parking permit shall have the opportunity to submit a renewal application starting July 20. Renewals shall take precedent over new applications.
   (E)   Fees.
      (1)   An initial administrative fee of $25 and an annual permit fee of $75 shall be paid upon issuance of a new permit.
      (2)   An annual permit renewal fee of $75 shall be paid thereafter for those permits which are renewed.
      (3)   A replacement decal fee of $25 shall be collected for a new decal.
   (F)   Issuance and revocation of permits.
      (1)   The permit application for an East Gate Area parking permit shall be submitted to the Board of Public Works. The Board of Public Works shall approve or disapprove the application, subject to the provisions of this section and the number of permits available. Should the number of permit applications exceed the number of unissued permits, the Board of Works shall establish a random assignment or some other equitable process to assign permits.
      (2)   The City's Board of Public Works & Safety shall have the authority to revoke any parking permit upon a finding of any violation of this section, and to order the revocation of the parking permit and forfeiture of all fees paid.
   (G)   Regulations for East Gate Area parking permit holders.
      (1)   Permits shall be restricted to one vehicle;
      (2)   Permits shall be valid until July 31 of each year;
      (3)   Parking spaces shall be used for passenger vehicles only; and
      (4)   Permits shall not be subleased or rented.
   (H)   Disposition of revenue. All funds derived from the granting of permits shall be placed in the Parking Meter Fund.
   (I)   Violations. Fees for violations of this subchapter follow the schedule provided in Ordinance 26-2010, as amended and codified in § 72.36 of the City Code. In addition to the foregoing, if a violation of this section occurs, the City of Valparaiso Police Department and/or its designee shall have the full right and authority to have the violating vehicle towed. The owner of the vehicle shall be solely responsible for all costs incurred as a result of having the vehicle towed.
