(a) To qualify for snow plowing, the following shall apply:
(1) The residence must be owner-occupied and the resident must be at least sixty years of age or temporarily or permanently disabled.
(2) There is no other able-bodied person residing with the resident capable of removing snow, be such person male or female, over sixteen years old.
(b) Applications for snow plowing must be made yearly to the Mayor for approval or disapproval.
(c) With respect to any particular property, the Mayor shall not make the authorization referred to in subsection (b) hereof unless and until he or she has determined that all Village roadways and the driveways and parking areas of all public buildings have been cleared of snow.
(d) The Village will provide snow removal service only when, as determined by the Service Department, there has been at least a cumulative four-inch snowfall locally measured at the Town Hall by the Street Commissioner or Service Department Foreman.
(e) The snow removal service, as provided for in this section, shall consist of a standard size snow plow making two passes on the resident's driveway, thereby making the public roads accessible to the resident's premises.
(f) All residents who qualify for the snow removal service will be expected to fully cooperate with the Service Department in providing the said service, and any abuses, as determined by the Street Commissioner or Foreman, will result in termination of said service.
(g) Both sides of a driveway shall be marked with tall indicator pegs or marker stakes every twenty-five feet.
(h) The owner of the property to be cleared shall execute the following statement: "In consideration of having the Village of Valley View clear my/our driveway of my/our residence of snow, I/we hereby authorize the Village of Valley View, its agents, servants and employees, to enter upon my/our property with snow removal equipment at any reasonable time, and I/we hereby agree to hold the Village of Valley View, its agents, servants and employees, harmless for any property damage that might occur as a result of the entrance onto my/our driveway, whether said damage is caused by an act of negligence or otherwise."
All signed statements shall be filed with the Clerk-Treasurer and shall be open to public inspection during regular business hours.
(i) The Service Department will plow all driveways that meet the criteria set forth in this section.
(j) Snow plowing will be performed with limited overtime as needed. Measurable snow depths to implement residential driveway snow plowing shall be determined by the Street Commissioner or Service Department Foreman. Staffing and vehicles for the program will be determined by the Street Commissioner.
(k) Residents with extremely urgent conditions such as medical obligations may contact the Mayor, Fire Chief, or Officer in Charge at the Fire Department for exceptional emergency arrangements.
(l) The Mayor shall approve all applications.
