660.22 COMMERCIAL TRASH CONTAINERS.
   (a)   All commercial trash containers used in the Village for collection of garbage, rubbish and other waste materials must meet the following specifications unless they are kept within a building which is kept locked or secured when employees are not present or out of view from the general public:
      (1)   They must be equipped with a rodentproof, tight-fitting cover.
      (2)   They must be equipped with locking casters mounted on wheels to restrain the movement of the trash containers.
      (3)   They must be kept in good repair.
   (b)   All trash receptacles shall be located wholly within the main building or in an approved enclosure structure. Exterior trash enclosures shall be six feet in height or of sufficient height to screen the containers from view, with masonry or other acceptable wooden design and with walls on three sides with a solid gate or door on the fourth side. The solid gate or door may be painted or it may be of a natural weather-type wood or wood component. Enclosures shall be designed to be compatible in design and material with the main building. Exterior enclosures shall be at least six feet from the main building and provide a setback from property lines equal to the required loading area setback. Where adjacent to residential districts, trash enclosures shall be further screened with a landscape buffer approved by the Planning Commission. Containers shall be placed behind the rear building lines unless approved in writing by the Building Inspector.
   (c)   Where existing trash containers are located on a parcel of land which does not have sufficient room for an enclosure, such trash containers shall be placed in a location which is determined and approved in writing by the Building Inspector.
   (d)   No person shall install, sell, lease or purchase any refuse container that does not conform to the minimum specifications set forth in this section.
   (e)   In accordance with this section, all newly manufactured or installed refuse containers and all existing refuse containers must meet these safety standards before January 1, 1994.
   (f)   Whoever violates or fails to comply with any of the provisions of this section is guilty of a minor misdemeanor for the first offense and a misdemeanor of the fourth degree for each subsequent offense within one year of the first offense. The penalty shall be as provided in Section 698.02.
