2-1-2: LIQUOR AND BEER SALES, HOURS EXTENDED:
   A.   Authority: This section is adopted pursuant to the authority conferred by Idaho Code section 23-927, as amended in 1986, and Idaho Code section 23-1012, as amended in 1987, which provide that a county may, by ordinance, allow the sale of liquor by the drink on Sundays, Memorial Day and Thanksgiving, and may also extend until two o'clock (2:00) A.M. the hours of the sale of liquor by the drink and the sale of beer.
   B.   Liquor, Hours Of Sale:
      1.   Hours Prohibited: No liquor shall be sold, offered for sale, or given away upon any licensed premises, and all liquor not in sealed bottles must be locked in a separate room or cabinet during the following hours:
         a.   Christmas Day from two o'clock (2:00) A.M. to ten o'clock (10:00) A.M. the following day.
         b.   On any other day between two o'clock (2:00) A.M. and ten o'clock (10:00) A.M.
         c.   On any day of a general or primary election until after the time when the polls are closed.
      2.   Consumption Of Beverages Already Served:
         a.   Time Limitation: Any patron present on the licensed premises after the sale of liquor has stopped as provided in subsection B1 of this section shall have a reasonable time, not to exceed thirty (30) minutes, to consume any beverages already served.
         b.   Penalty: Any person who consumes or intentionally permits the consumption of any alcoholic beverage upon licensed premises after the time provided for in subsection B1 of this section shall be guilty of a "misdemeanor" as defined in Idaho Code sections 18-111 and 18-113.
      3.   Duty To Comply: It shall be the duty of every person who is employed at or upon a licensed premises or who owns or manages a licensed premises and is present upon the licensed premises during the hours and at the time set forth in subsection B1 of this section to lock up and keep locked up in a locked room or locked cabinet all unsealed containers of liquor during the hours and at the times set forth in subsection B1 of this section, and any such person who fails to perform the duty provided herein shall be guilty of a misdemeanor as defined in Idaho Code sections 18-111 and 18-113.
   C.   Hours Of Sale Of Beer:
      1.   Hours Prohibited: It shall be unlawful and a misdemeanor for any person in any place licensed to sell beer or where beer is sold or dispensed to be consumed on the premises, whether conducted for pleasure or profit, to sell, dispense or give away beer between the hours of two o'clock (2:00) A.M. and seven o'clock (7:00) A.M.
      2.   Consumption Of Beer Already Served:
         a.   Time Limitation: Any patron present on the licensed premises after the sale of beer has stopped as provided in subsection C1 of this section shall have a reasonable time, not to exceed thirty (30) minutes, to consume any beverage already served.
         b.   Penalty: Any person who consumes or intentionally permits the consumption of any alcoholic beverage upon the licensed premises after the time provided in subsection C1 of this section shall be guilty of a misdemeanor. (Ord. 87-2, 6-22-1987)
