§ 94.084 ABANDONMENT FOR MAINTENANCE CRITERIA.
   The road viewers shall recommend abandonment of the subject road for maintenance if they determine that the road is not presently needed and if they reasonably anticipate that the road will not be needed within the next 2 years. Alternatively, the road viewers shall recommend abandonment of the subject road for maintenance if the repairs of the subject road are burdensome and in excess of the benefits of continuing maintenance on the road, and if they reasonably anticipate that condition to continue for the next 2 years. In determining whether the road is presently needed, the road viewers shall consider whether those whose property abuts on or adjoins the road proposed for closures still would have reasonable access to the general street or road system if the road were abandoned for maintenance.
