§ 7-4-1 DEFINITIONS.
   When used in this chapter, the words and phrases defined in this section shall have the meanings respectively ascribed to them as follows.
   BICYCLE. Every device, propelled by human power and upon which any person may ride, having two wheels in tandem.
   BICYCLE AND PEDESTRIAN PATHS. That portion of the public domain specifically dedicated and designed for the exclusive use of bicycles and pedestrians and so described on the official bicycle and pedestrian path map on file with the Town Clerk, and excluding therefrom all portions of the bicycle and pedestrian paths which may otherwise be dedicated as public streets.
   ELECTRIC ASSISTED BICYCLE. A vehicle having three wheels or less, fully operable pedals and an electric motor not exceeding 750 watts of power rating, and conforming to one of the classes as follows.
      (1)   CLASS 1 ELECTRIC ASSISTED BICYCLE. Means an electrical assisted bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches a speed of 20 mph.
      (2)   CLASS 2 ELECTRIC ASSISTED BICYCLE. Means an electrical assisted bicycle equipped with a motor that provides assistance regardless of whether the rider is pedaling but ceases to provide assistance when the bicycle reaches a speed of 20 mph.
      (3)   CLASS 3 ELECTRIC ASSISTED BICYCLE. Means an electrical assisted bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches a speed of 28 mph.
   ELECTRONIC PERSONAL ASSISTIVE MOBILITY DEVICE (EPAMD). A self-balancing, non-tandem two wheeled device, designed to transport only one person, which is powered solely by an electronic propulsion system producing an average power output of no more than 750 watts.
   LIGHTWEIGHT ELECTRIC VEHICLE. Any device capable of moving itself, or of being moved, from place to place upon a wheel or wheels that is powered by a battery and weighing less than 50 pounds, including without limitation an electric scooter, an electric skateboard, an electric unicycle, and a self-balancing single-wheel electric personal transport board.
   LIVESTOCK. Horses, cattle, sheep, goats, pigs and any other farm animal.
   MOTOR DRIVEN CYCLE. Every motorcycle, including every motorscooter, bicycle with motor attached, trail bikes, minibikes, go-carts, golf carts and similar vehicles.
   MOTOR VEHICLE. Any self-propelled vehicle, other than an electric assisted bicycle or electronic personal assistive mobility device (EPAMD), which is designed primarily for travel on the public streets and highways and which is generally and commonly used to transport persons and property over the public streets and highways.
   MOTORCYCLE. Every motor vehicle designed to travel on not more than three wheels in contact with the ground.
   NON-MOTORIZED VEHICLE. Any wheeled vehicle used for transporting a person, other than a bicycle or electric assisted bicycle, which is not propelled by a motor or engine, including without limitation roller skates, skateboards, and roller skis.
   PEDESTRIAN. Any person afoot.
   PEOPLE POWERED VEHICLE. Every vehicle propelled by human power, having a body, three or more wheels, and a seat or seats for two or more persons.
   PUBLIC STREETS. The entire width between the boundary lines of every way publicly maintained when any part thereof is open for the use of the public for purposes of vehicular traffic.
   RIGHT-OF-WAY. The privilege of the immediate use of the bicycle and pedestrian path, this being the right of one bicycle or pedestrian to proceed in a lawful manner in preference to another bicycle or pedestrian approaching under such circumstances or direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other.
