(A) If the owner fails to timely and fully comply with the notice described in § 5-14-6 of this chapter, the town may complete the removal of the encroachment and the associated restoration activities and recover its costs as provided in subsection (D) of this section.
(B) The town shall not be responsible for any property loss or damage that occurs in connection with abatement pursuant to this section.
(C) In the case of an emergency involving imminent danger to the public health, safety or welfare, the town may authorize the immediate removal of any encroachments without notice.
(D) The owner shall be assessed twice the entire cost of removal of the encroachments and restoration activities. If all costs and charges incurred by the town are not paid within 30 days of the date of the assessment, the unpaid costs shall be certified to the Eagle County Treasurer for collection in the same manner as real property taxes.
