(A) Utility locations. Existing utilities are to be located by the respective utility company or acknowledgment that no utility is located in the construction area. This process shall be accomplished as the permittee procures a public way permit by signing of the permit by each utility listed on the permit.
(B) Existing utilities.
(1) Reasonable care shall be exercised in showing the location of existing utilities on the plans. The exact location of such utilities may not be known in all cases. The contractor shall explore the area ahead of the ditching operation by observation and/or electronic devices to locate such utilities in advance of trenching operations, and shall conduct his or her work so as to minimize damage to the existing structures.
(2) Existing utilities shall be properly supported as required by the owner and protected from damage during the progress of the work. All pipe lines, utilities or structures which are broken or damaged shall be reconstructed of the same material, to the satisfaction of the owner. Where it was reasonably possible for the contractor to have located the utilities, he or she shall assume the responsibility for proper repair or replacement to them. The contractor shall immediately report any damaged utilities.
(3) The contractor shall contact the owners of all irrigation ditches, and make arrangements for necessary construction clearances and/or dry-up periods.
(4) All irrigation ditches, culverts, catch basins, headgates, pipe, valves, checks and the like, damaged or removed by the contractor, shall be restored to their original condition or better, at the contractor’s expense.
(C) Protection of existing structures.
(1) Where trenches are located closely adjacent to buildings, foundations and structures, the contractor shall take all necessary precaution against damage to them. The contractor shall be liable for any damage caused by the construction.
(2) Trees, fences, mailboxes, poles and all other property shall be protected unless their removal is authorized by the Town Engineer, and property damaged or removed shall be satisfactorily restored by the contractor at his or her cost, in no more than 30 calendar days.
