§ 13-3-5 REVIEW AND APPEAL PERIODS, FALSE STATEMENTS.
   (A)   Commission decision. The Planning and Environmental Commission shall have 21 days from the date of reviewing the preliminary plan to approve, disapprove or approve with conditions or modifications, unless a longer period of time is agreed upon by the subdivider and the Planning and Environmental Commission or the preliminary plan shall be deemed approved.
   (B)   False information. It is unlawful for any person to intentionally or knowingly submit a false statement as part of an application for subdivision approval, exemption or exception.
   (C)   Council may appeal. Within ten days the decision of the Planning and Environmental Commission on the final plat shall be transmitted to the Council by the staff. The Council may appeal the decision of the Planning and Environmental Commission within 17 days of the Planning and Environmental Commission’s action. If Council appeals the Planning and Environmental Commission’s decision, the Council shall hear substantially the same presentation by the applicant as was heard at the Planning and Environmental Commission hearing(s). The Council shall have 30 days to affirm, reverse or affirm with modifications the Planning and Environmental Commission decision, and the Council shall conduct the appeal at a regularly scheduled Council meeting.
