151.15 RETIREMENT AGE.
   (a)   Each police officer in the employ of the Village shall retire at an age no later than sixty-two (62) years, unless the Village receives, as set forth below, a physician’s report indicating that the officer is physically able to continue in the capacity of a police officer. For an officer over the age of sixty-two years to continue employment as a police officer, the Village must receive a physician’s report every two years, which report must indicate that the officer is physically able to continue in the capacity of a police officer. Council has determined that the vast majority of officers over the age of sixty-two years may be physically incapable of performing the strenuous physical duties required of police officers in their normal line of duty. To the extent that certain individuals over the age of sixty-two may be physically capable of performing such duties, Council has determined that each officer, when he or she reaches the age of sixty-two, and every two years thereafter, be required to take a physical exam to determine whether that officer is physically able to continue in the capacity of a police officer. A doctor will be specified by the Village of Utica to conduct the required physical exam at Village of Utica’s expense.
   (b)   Except as provided in subsection (a) hereof, Village employees shall not be required to retire at any given age, but may continue to serve so long as they are physically and mentally capable of performing assigned task.
