§ 160.46 EXTRACTIONS OR MINING.
   (A)   Extractions or mining of rock, stone, gravel, sand, earth or other minerals shall not be allowed unless and until the Board of Adjustment has granted a conditional use permit, except for the following defined extractions and deposits:
      (1)   Removal of less than 1,000 cubic yards of earth from the premises;
      (2)   Grading which has been approved in accordance with the Subdivision or Site Plan Codes; and
      (3)   Excavations by any public agency or public utility for the installation, operation, inspection, repair or replacement of any of its facilities.
   (B)   If the Board of Adjustment grants a conditional use permit for extractions or mining, the Board may place whatever limitations and requirements on the permit that the Board finds to be necessary to protect the public health, safety and general welfare and to protect property values, including but not limited to insurance against liability arising from production or activities or operations incident thereto; designation of area in which work may be done within one or more time periods, and a final date upon which all extraction or mining operations will cease; designation of the slope to which excavation may be made or the grade of filling; provisions for controlling dust; operating hours; traffic control and vehicular circulation into, around, and by said operation; perimeter buffer yards; plan for restoration and use upon completion of the extraction or mining work, including but not limited to establishment of vegetation over the entire land area to prevent erosion and restore esthetics; posting of a good and sufficient surety to ensure compliance with the conditional use permit; and any other conditions deemed necessary by the Board of Adjustment.
