(A) Any person claiming to be aggrieved or to have witnessed bias based profiling may file a complaint. Further, no person shall be discouraged, intimidated or coerced from filing such a complaint, nor shall any person be discriminated or retaliated against because they have filed a complaint.
(B) Any employee observing bias based profiling by another employee shall immediately tell the employee displaying the behavior to stop or report the incident to a supervisor immediately. Further, any employee who stops or reports any practice in violation of this subchapter shall not be discriminated against in any manner for opposing such conduct, testifying, assisting or participating in any investigation, proceeding or hearing arising out of a violation of this subchapter.
(C) Employee complaints shall be filed with the employee’s supervisor, division commander or the Police Chief. Any external complaints shall be filed with the Police Department or the City Manager’s office.
(D) Bias based profiling complaints received by the Police Department or City Manager shall be investigated by the Police Department’s Internal Affairs Unit. When necessary, an alternate investigator may be assigned by the Chief of Police.
(E) The Police Chief shall provide a statistical summary report at least annually to the City Council and Mayor on all bias based profiling complaints reported. The report shall be for each calendar year and be completed as soon as practical after the calendar year has ended.
