(a) It shall be unlawful for the driver of any vehicle to use or operate or cause to be used or operated within the corporation limits of Upper Sandusky, Ohio, any mechanical exhaust device or engine retarder designed to aid in the braking or deceleration of any vehicle in such a manner as to cause the exhaust system to emit a loud, cracking, explosive or chattering noise unusual to its normal operation, otherwise commonly known as “jake braking”.
(b) Signs shall be posted at all major entry points into the City indicating that all such mechanical exhaust braking systems are prohibited in the City of Upper Sandusky.
(c) Whoever violates the provisions of this ordinance is guilty of a minor misdemeanor; on each subsequent offense within one year after the first offense such person is guilty of a fourth degree misdemeanor.
